OBTAINING THE REPAIR SERVICE

You will be contacted by our backend support team and You will be required to

(1) provide Your registration number

(2) provide an alternate contact number.

(3) submit the Pattern/Screen/Password lock if the Handset is locked. Please do not submit your SIM Card/Memory Card or any other accessory along-with Your handset. A pickup will be scheduled.

You will need to provide a Government approved ID proof.

If the pickup is not ready at the scheduled time and place, the Job will be cancelled & the pickup will have to be rescheduled.Handling fees of Rs.200/- would apply in this case.

All handsets are received and opened by Us under CCTV surveillance and the condition recorded. If there is any evidence of damage, We will email a photo of Your Handset to Your email ID. This photo shall be the basis of establishing the condition of the Handset, and in case of any dispute about the contents of the Package our evidence and decision shall be final.

The 10 day Repair guarantee is subject to part availability, Handset availability and logistics availability in Your area.

The Handset will be reset to factory condition for testing purposes. And all data will be deleted for security reasons. Our testing is limited to the testing of the Handset in its original condition and We do not assure the working of the Handset with any Apps. Kindly take a backup of your data before submitting Your handset to Us for Repairs.

Please submit Your battery with the Handset when You require our repair services because batteries are the cause of many defects and need to be checked. Do not however send any accessories with the Handset for repair.

EXCLUSIONS

The following exclusions apply

In case of tampered handsets this evidence will be provided and will be considered final and no further Repair services shall be offered for such instances.

Data Loss caused during REPAIRS. All handsets will be factory reset for testing purposes & You are therefore strongly advised to save and make backup copies of any programs, data before submitting the Handset for repairing.

Transit Damage due to improper packing when sending Handset to Us.

HANDLING / STORAGE / DISPOSAL CHARGES

Handling charges Rs.200/- shall apply and be payable by You in case of Handset is not repairable for reasons of application of exclusions to our Services or if no defect is found in the Handset.

If a repaired Handset is used with accessories, or applications or SIM/ Memory which are not original, or are compromised / expired, as a result of which You incorrectly consider the repair as unacceptable, a Handling charge of Rs.200/- shall be payable before the Handset is returned You.

If a Handset is either not claimed or is not deliverable based on the contact data provided by You, within 60 days, We will be within the rights to dispose the Handset as We deem fit and You will have no further claim on Us in this regard.

LIMITED LIABILITY

We do not take any responsibility for the Integrity of contact/image/video data in the Handset during the repair process. You MUST back up the data before handling over the Handset for Repair.

We will under no circumstances be or held liable for any special, indirect, incidental or consequential damages resulting from servicing and/or repairing of the goods, including but not limited to of, damage to, or corruption of data; or any costs of recovering, programming, or restoring any program or data stored in the Handset and any failure to maintain the confidentiality of the data stored on the Handset.

In the event any Handset is lost by theft or accident while in Our custody, the maximum liability will be limited to compensation with a Handset of similar value, specification and age or the limits placed by the maximum claim revaluing the value in our software.

Maximum care will be taken in handling the Product, but no claims will be accepted for cosmetic issues like dent, scratches and minor defects.

If Your battery has reduced capacity or performance, You will be informed and We will not be responsible for the performance of the repaired Handset if You do not replace the battery with a new and original one immediately before testing Your repaired handset.

We shall not be held liable for any consequential damage including monetary loss or loss of business as a result of any delay caused by, an act of God, theft, loss, accident, delay in delivery or inability to obtain necessary labour, materials, transportation facilities etc. In the event of any such delay, the date of delivery shall be extended for a period equal to the time lost by reason of the delay. It shall be Our endeavor to keep You informed of such events in advance to minimize the inconvenience that may be cause.

Legislation including the Trade Practices Act, the Consumer Act and other local legislation implies warranties and conditions into consumer contracts. These warranties and conditions exist separately from and are not affected by the warranties referred to in this contract given by Chanel 5 Repair. Subject to such legislation and to the warranties and conditions contained in this contract , all other warranties, conditions and liabilities are hereby excluded and Chanel 5 Repair shall not be liable for any direct or indirect loss or damage of any kind arising from the provision of any kind of warranty Service here under the terms and conditions of this contract or arising from the negligence of Chanel 5 Repair its Authorized Seller’s employee, agents or subcontractors.

LEGAL OWNERSHIP

We can only accept Handsets which have been acquired by You by bonafide means. By purchasing agreeing to our Repair services, You will be declaring that You are the legal owner or duly Authorised representative of the owner of the Handset.

In support of this You may be required to provide valid ID proof at any time of Pick up or walk in.. Any Govt. ID shall be acceptable. In the event this is not available, You will agree to have a photograph and mail sent through your registered mail id..

If We receive any written government enquiries, enquiring about Your Handset or requiring it to be handed over, We shall do so forthwith, without reference to You and shall have no claim on it thereafter, and We shall have no liability either for the return of the Handset.

“REPAIR NOW” – CHARGEABLE REPAIRS

Clients who require Instant Repair shall be charged Extra and for which an estimate will be provided.

If accepted, these repair charges shall be payable by You before the Handset is taken up for repairs.

The parts replaced and the labor services for these repairs shall be warranted for a period of 30 days. This warranty shall cover only the parts replaced by Us.

REFUND AND CANCELLATION POLICY

Since chanel 5 Repair is offering services irrevocably, we do not issue refunds once the order is accepted, the product is sold and payment received.

DISPUTE RESOLUTION

Disputes regarding our Services shall be attempted to be resolved through consultation, discussion and good faith. In the event such dispute cannot be resolved within a period of 30 days by way of consultation, such dispute shall be referred for arbitration in accordance with the Arbitration and Conciliation Act, 1996, or any modification or amendment thereof. The arbitration shall be held in Pune, Maharashtra, INDIA. The decision of such arbitration shall be binding and conclusive.

Scope of Warranty Coverage

Warranty is limited to the parts and/or service(s) that were paid for. If only parts were purchased, warranty is limited to the replacement of the parts. If parts and repair service were purchased, warranty extends to cover the labor cost of part replacement and any other repairs specifically resulting from the initial repair, except in the situations outlined below.

1. Subsequent mishandling that causes the frame to bend, twist, or crack
2. Water damage

5. Damage resulting from attempted customer repairs

7. Jail broken devices
8. New damages unrelated to the original repair
9. Any loss of data occurring as a result of the repair

Our warranty also does not cover the outcome of a repair if certain pre-repair conditions exist, including:
Existence of known manufacturing and/or performance issues related to the device separate from the repair, as noted prior to the repair Existence of damage to the frame of the device, as noted prior to the repair Water damage Jailbroken devices.
Tampering with internal hardware: under certain conditions, internal damage may make a repair impossible. Your repair specialist will be able to explain in further detail upon diagnosing your specific device. If a customer device is irreparably damaged as a direct result of a repair attempted by krishna online store and payment has been rendered, the customer is entitled to a fully functional refurbished device of equal or greater value of the damaged device based on its model and condition as received and with the original repair issue resolved, or the monetary equivalent of fair market value of the device in that condition as determined by krishna online store . If payment was not rendered for service, the repair quote shall be deducted from the value, or a refurbished device of the same damaged condition as received shall be offered. In order to receive a replacement device, the customer’s damaged device must be rendered to krishna online store .

I authorize krishna online store to perform repair work on my iOS® or Android® or any other OS Device. I understand that the krishna online store repair specialists have been trained to perform iOS® or Android® or any other OS device repairs, but krishna online store and its affiliates are not an Authorized Service Provider (ASP) of any Original Equipment Manufacturer (OEM), and are in no way affiliated with any OEM, unless specified. Further, I agree to release, indemnify, and hold krishna online store and the owner company AquaSecond hand smartphones pvt ltd from liability for any claims or damages of any kind or description that may arise from any OS device repair work performed, unless it is caused by severe negligence of krishna online store, or its agent.
I understand that krishna online store. has no liability for any data loss, which may occur as a result of work done on my device. I also understand that I have the option to, and I am responsible for backing up the device before allowing krishna online store to work on my device in the event of any data loss and hardware or software failure.
I understand that repairs or technical support rendered by krishna online store may void manufacturer warranties for this iOS device. krishna online store and its affiliates do not assume any liability or warranty in the event that the manufacturer warranties are voided but may, at its sole discretion, offer its own warranty on the parts and/or services performed.
I further understand that it is my responsibility to inform krishna online store accurately with regard to the model description and condition of my device, as well as whether any modifications or repairs have previously been attempted or completed. An krishna online store repair specialist will perform a check-in diagnosis of my device to evaluate its condition. If the device arrives at krishna online store in noticeably different condition than previously described, I acknowledge that additional charges may apply. As the customer, I recognize that the careful shipping of my device to krishna online store is my responsibility. If the product arrives with further damage, or is lost in transit, I bear full responsibility for that risk of loss as the shipper.
If any device should be lost or damaged further than the condition it was released to krishna online store in, krishna online store ’s liability will be limited to the cost of repair or replacement of the device in its condition at the time of transfer to krishna online store based on current fair market value. krishna online store ’s liability for damages from any cause when it comes to repairing your product is limited to the cost of the repair service or a comparable replacement device. krishna online store and its affiliates have no liability whatsoever for indirect or consequential damages resulting from a repair or repair attempt, including any lost or damaged data, software, or lost profits or revenue of the customer.
Warranty Terms
As part of the repair services provided to the Customer (“You”), repair department is providing replacement parts (“Parts”) and accessories (“Accessories”) supplied by krishna online store (“Company”). The company is a third party obligor of service obligations to you under your agreement with Krishna online store, regarding your use of, and rights related to, the Parts and Accessories.

Limited Warranty

Company warrants to you that from the date the Parts or Accessories are provided to you for a period as specified to you on your Bill/ Invoice/ Delivery Challan (“Warranty Period”), each Part and Accessory provided to you under this Agreement will be materially free of manufacturing defects. Company’s sole obligation, and your sole remedy, under this warranty is limited to, at Company’s sole discretion, repair or replacement of the defective Part or Accessory. This warranty is non-transferable.

Company’s obligations under this warranty are conditioned on your prompt notification to the Company of any warranty claim and complying with Company’s then-current warranty procedures provided to you. This warranty specifically excludes

(i) any Part or Accessory that was altered, repaired, or modified by a party other than Company without Company’s prior written consent;

(ii) any defects, damage or errors that

occurred after shipping by Company,
were the result of improper testing, installation, storage, mishandling, abuse, misuse, accident or causes other than ordinary use of the Part or Accessory, or
use of the Part or Accessory in conjunction with another product which is incompatible, or of an inferior quality;

(iii) warranty claims by any individual other than you, or warranty claims after the Warranty Period; and (iv) any warranty claim for which Company determines that there is no defect in the returned Part or Accessory.

You must comply with the additional warranty and return procedures provided to you by Company. You assume risk of loss or damage to any Part or Accessory returned to Company for repair or replacement until delivery to Company.

EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE COMPANY, NOR THEIR SUPPLIERS OR LICENSORS MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE PARTS OR ACCESSORIES. ALL PARTS AND ACCESSORIES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, AND ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.

Limitation of Liability

NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, COMPANY WILL NOT BE RESPONSIBLE OR LIABLE TO YOU UNDER ANY CONTRACT, TORT, STRICT LIABILITY OR OTHER THEORY FOR ANY DAMAGES RELATED TO YOUR USE OF THE PARTS OR SERVICES, INCLUDING WITHOUT LIMITATION (A) FOR ERROR OR INTERRUPTION OF USE, LOSS OR CORRUPTION OF DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY, OR LOSS OF BUSINESS; (B) FOR ANY INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES OR FOR LOSS OF PROFITS; OR (C) FOR ANY AMOUNTS THAT ARE IN EXCESS OF THE TOTAL AMOUNTS PAID BY YOU FOR THE PART OR ACCESSORY FROM WHICH SUCH DAMAGE AROSE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, AND Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.
